“The Often-Imitated, Never-Duplicated Barran Liebman Case Law Update” (Presented by Sean Ray

In this presentation, Sean Ray will cover the most recent legislative and regulatory updates at the  state and federal level. Topics will include the NLRB’s new standard for unlawful employer rules and representation proceedings; the Pregnant Workers Fairness Act; changes to Oregon OSHA investigations and penalties; changes to the interplay between OFLA and Paid Leave Oregon; Oregon HB 3471; and rules to watch. With each legal development, Sean will provide attendees with practical tools and advice on how to adapt to these changes and maximize compliance in their workplaces.

“Write This Down: How to Avoid Documentation Issues & Set Yourself Up for Success” (Presented by Chris Morgan

In this presentation, Chris Morgan will cover top disciplinary and documentation considerations with an eye towards the role of discipline in the modern workplace and how to best protect an organization with a defensible disciplinary record. With an increasingly litigious employment environment, Chris will provide an overview of basic documentation best practices while highlighting lessons from recent litigation.

“Don’t Let Workplace Tech Get Your Wires Crossed” 

(Presented by Sean Ray

In this presentation, Sean Ray will discuss how employment law is changing in response to emerging technological trends. With recent decisions and developments to serve as examples,  he will explore areas in which technology is shaping rights and responsibilities in the workplace,  including considerations for allowing telecommuting as a reasonable accommodation, whether  employers can place restrictions on what employees say about their company on social media,  whether employees have a right to use their employers’ email system for union organizing or  other activities, pitfalls and perils of a BYOD (bring your own device) workplace, GPS monitoring of employees, and more. Each consideration will be approached with the objective of helping employers avoid common mistakes in light of today’s technological advances.

“Cover Your Class: Ways to Ensure Classification Issues Don’t Come Back to Bite You” (Presented by Chris Morgan

In this presentation, Chris Morgan will help employers demystify the complex issue of worker classifications. In doing so, he will cover the important legal distinction between independent contractors and employees, including the key legal tests relevant to that analysis. He will also cover exempt vs. non-exempt employee classifications and best practices for tailoring positions to ensure compliance with wage and hour laws.
